This paper examines the relationship between legal transplant and legal translation and their roles in cultural transfer. It classifies legal transplants into two kinds: legal imposition at the socio-political level and legal translation at the socio-linguistic level. Legal translation is usually the major conduit of legal transplant in the case of legal reform in the receiving country. Since transplantation involves the transfer of the conceptual thinking of the imported law, legal transplant often brings about a transfer of legal culture. Legal translation as a form of legal transplant always involves the transfer of the legal culture of the translated law at the socio-linguistic level. Legal translation in the context of Hong Kong serves as a case of foreignization, requiring both linguistic and conceptual adjustment of the translating language to accommodate the imported culture.

Cultural borrowing between the English and Slavic languages in the last one hundred years, and especially in the latter half of the twentieth century was mostly a unidirectional process with the English as the source and Slavic languages as the target. This paper is an attempt to fill this void in examining the other direction of lexical transfer between English and Slavic languages. The following general conclusions can be drawn from the analysis: a) Lexical and cultural influence from subordinate to dominant language is by and large limited to the culture-bound items. Borrowed vocabulary items remain marginal in the overall English vocabulary. Several exceptions from this trend, i.e., the words which have made it to the core of the English vocabulary, are result of the butterfly effect and cannot be accounted for by some general trend; b) Lexical influence of each particular language is directly proportionate to language size. Exceptions from this general trend occur, as demonstrated by East Slavic languages, when one Slavic language clearly dominates others; c) The timeline of borrowing is directly proportionate with the growth and deepening of international communication networks in the nineteenth and in particular twentieth centuries.

Обґрунтувано аспекти психопоетики і психоісторії як принципово нові дослідницькі стратегій в осягненні творчих здобутків української літератури. Застосована у статті методологія нового історизму дозволила розглянути втілені в літературі історичні образи крізь призму емоцій, колек-тивного психічного досвіду нації. Підкреслено конструктивну роль емоцій у транстекстуальних практиках, міграціях сюжетів, зіставлених у перспективі віддалених культурних епох. У площині культурного трансферу емоції досліджуються у творах Г. Квітки-Основ’яненка і В. Наріжного.

Розглянуто колоніальний ресентимент як національний психоемоційний комплекс, прояв колек-тивної чутливості, троп, фігуру мовлення, елемент контроверсійного письма в українській літерату-рі. Застосування емоціонологічного підходу до вивчення націй, етнічних груп вельми продуктивне з огляду на створення альтернативних психоісторій і психопоетики національних літератур, пост-колоніального прочитання традиційних наративів, локальної історії як картографованої чутливо-сті. Зосереджено увагу на ресентименті, варіативності його проявів у творах письменників, просте-жено зв’язок комплексу національно-історичної образи з психологією колоніальної впокореності і підімперським статусом самої української літератури першої половини XIX ст. Доведено доціль-ність антропологічного підходу до типології націй як емоційних спільнот з притаманними їм емо-ційними стандартами і режимами, обґрунтовано потужний вплив європейських романтичних док-трин, зокрема Й. Г. Гердера, на формування націєцентризму української літератури. Акцентовано національну специфіку емоційної поведінки і пов’язаних з нею проявів помсти, класової ненависті, насильства, соціальної агресії, виявлено вплив повстанських рухів, психології бунту на формування антиколоніального світогляду. Твори В. Наріжного і Г. Квітки-Основ’яненка проаналізовано з точ-ки зору антропологізації жанру, репрезентації національної історії в жанрових формах і в площині націєрозповідності.

Abstract

The present paper deals with the correspondence of Count Johann Mailáth, a supranational go-between in the first half of the 19th century. The essay is a stocktaking of Mailáth's letters, they are collected in the Austrian National Library and the Vienna City Library. The author of the article would like to show that 1) Count Mailáth can be seen as a multiple “Grenzgänger” between communication spaces, languages and genres and 2) that the analysis of his multilingual and multiethnic network can determine several turning points in his writing career. The aim of the contribution is to supplement the previously known biography of the author and to define epochal boundaries in his oeuvre.

The translation of advertising as written text still demonstrates many of the problems of cross-cultural transfer which have formed the object of Translation Studies research in recent years. Source text induced target text production is very often the norm, with more of a documentary than instrumental view of the intended ST/TT relationship (Nord 1991). Marketing experts do not always fully exploit the expertise of the translator, although not to do so may (sometimes seriously) affect the success of an advertising campaign. This paper, on the one hand, seeks to highlight some of the problems observed in advertising texts in the language pair English-French and, on the other hand, to discuss the relevance of culture-specific factors of a message in the functionally-successful translation of advertising texts.

Abstract  

The article analyzes a special mode of a comparative activity, namely the “intercultural” comparison as a phenomenon of modernism and post-modernism. Faced with the pressure put upon them by the continuing process of globalization and world-wide streams of migration, new literary developments are surfacing, as well as new methodological (comparatist) approaches like the research of cultural transfer or intercultural discourse analysis. Since culture is no longer perceived as a self-contained entity, but as an open intercultural process (Homi K. Bhabha), it brings forth culturally “hybrid” works of literature. Such a literature is determined and lent special dynamics by a dialectical dichotomy (or even a paradox) of adaptation (globalization, universalism) and resistance (local difference). The latter can be exemplarily demonstrated by the interrelation between western and eastern culture. This interrelation is founded upon a long tradition, for example with respect to Goethe and Hafz, although it is being perpetuated in new and critical ways by authors like Rushdie and Djebar. This article also sets out to illustrate that on the one hand the post-modern hybridization of literature corresponds to a new, post-colonial reality (which is not conceptualized in a eurocentrist way), while, on the other hand, it must be classified as an artifact and a conscious construction. Most paradoxically, the novels under scrutiny use the very aesthetic procedures that we find in the European (Manierist) tradition.
